On September 2nd. 2008, there was a pre-trial for Nixzmary Brown's mother, Nixzaliz Santiago, held at Brooklyn Supreme Court. THIS WAS THE ONLY PRE-TRIAL HEARING THAT I WAS NOT PRESENT FOR. The d.a.'s had called the media the night before and informed them of this hearing and told them to come in the next day. The public had no way of knowing.
Here's what happened at the hearing, from published newspaper accounts: It was revealed that the prosecution is in possession of 3 dvd's that were seized from a home computer that show a skinny but apparently healthy, Nixzmary Brown. She's singing and dancing at a birthday party for one of her younger siblings. There's about 45 minutes worth of home movies that were taken with a Sony video cam. The defense wants to introduce these home movies of a happy Nixzmary to contrast the graphic autopsy photos that the prosecution plans on showing at the trial. The d.a. has repeatedly said that Nixzmary Brown was treated badly by her family and these home movies tell a different story. The prosecution is objecting to the introduction of these tapes.
Cesar Rodriguez's attorney, Jeff Schwartz, has said that he had no idea of the existance of the tapes. Schwartz could've used the tapes at Cesar's trial to contradict the prosecutions assertations that Nixzmary was treated badly at home. Schwartz has repeatedly said that the prosecutors were withholding evidence from him and he could now potentially use these tapes as ammunition to get Cesar a new trial.
It was also revealed that the prosecution has two secret witness, one of which, claims that they had conversations with Nixzaliz about her suspecting that Cesar was molesting Nixzmary. The secret witnesses are scheduled to come in and testify at the next hearing.
Personally, I think the secret witness is Cesar's sister, Iris Rodriguez. We learned at Cesar's trial that Nixzmary told her aunt Iris that Cesar was molesting her. When they confronted Nixzmary and she saw how serious the situation was, she took it back. They all thought she was making it up to go live with her grandmother in Puerto Rico. That's who my guess is on who the secret witness is. I could be wrong but I don't think I am.
Asst. d.a., Linda Weinman revealed that the prosecution plans on using as a motive, that Nixzaliz was jealous of Nixzmary because she believed the 7 year old was having sex with her husband. Weinman said that jealousy is why she allowed and even provoked her husband to beat and torture Nixzmary.
The prosecution requested that the trial date be postponed until September 15th. The judge agreed.
Although I was not present at this hearing to hear this for myself, someone that was in the room, that has no reason to lie, told me that at this hearing, the lead D.A., Ama Dwimoh, asked to be released from the case citing that there are other people better acquainted with the case than herself. The witness said Judge DiMango refused to release her from the case saying that she’s been on the case for almost 3 years and there’s no one better acquainted with the case than her.
