Nixzmary Mom Trial, Day 6: Crime Scene Detective & DNA Expert Testify!

Nixzmary Brown detective, Joseph Bello(Photo: Det. Joseph Bello)

By: Dovesblood

Sept. 22nd.,2008 was the 2nd. day of testimony in the murder trial of Nixzmary Brown's mother, Nixzaliz Santiago. First, I'll say what happened in a nutshell then I'll go into detail as to what the witnesses testified to.

HERE'S WHAT HAPPENED IN A NUTSHELL: First witness, Det. Joseph Bello. He's the crime scene detective who drew a map of the apartment, photographed Nixzmary on the floor, and collected the evidence.

Bello was shown photos and physical evidence that he collected from the apt. One highlight of his testimony is when he discussed the "fetus in the jar" and Sanchez said to him that no one in their right mind would think that's a baby. Sanchez was inferring that Nixzaliz was not in her right mind thinking the placenta tissue was a real baby.

2nd witness: DNA expert, Taylor Dickerson. He works for the Medical Examiner and did the DNA testing to check for blood on items from Nixzmary's apt. Taylor Dickerson identified all of the items that were tested for blood or that had DNA found on them. The highlight of his testimony was when he stated that all of the blood found belonged to Nixzmary and either Cesar or Edward. That no unknown female blood was found, meaning Nixzaliz's blood was never found in connection with Nixzmary's.

HERE'S THE TESTIMONY IN DETAIL: Sept. 22nd.2008 was the 2nd day of testimony in Nixzaliz Santiago's murder trial. Judge Patricia DiMango was wearing a black sleeveless dress with a belt that had a large buckle, underneath her robe. Lead DA, Ama Dwimoh (ja-mo) was wearing a gray skirt suit, asst. d.a., Linda Weinman was wearing a dark black skirt (don't rememeber what color top she was wearing) asst. d.a., Anthea Bruffee, was wearing a metallic blue suit. Nixzaliz was wearing a brown jacket, a purple shirt underneath and navy blue jeans. Her hair was in a bun with a satiny brown scrunchie and she wore black rimmed glasses.

Judge DiMango addressed the issue of three media outlets, The New York Daily News, El Diario (a Spanish newspaper) and Channel 11 petitioning to take photographs of the evidence. DiMango ruled that she'd allow only still photos and video without sound to be taken. No post mortem photos and all the photos have to be taken in her presence. A Daily News photographer, Jesse Ward, went up to DiMango's bench to talk to her. Nixzaliz was chatting with the Spanish translator, Jeanette. Asst da. Bruffee brought the evidence cart out, d.a. Weinman asked for latex gloves (to handle the evidence) then put Nixzmary's clothes (red sweatsuit and lavender top) and her Donald Duck pillow out on the table in front of the prosecution's desk. A guard brings out a black garbage bag and when it's unwrapped it's the litter box that little Nixzmary was forced to use. There are also 3X2 manilla envelopes with samples of excretement in the box. Nixzaliz watches.

Judge DiMango who was wearing the traditional black judges robe, is now wearing her robe off of one shoulder, so her shoulder is exposed. The off the shoulder robe is her trademark.

The first witness was Detective Joseph Bello. Det. Bello is probably in his late 40's to early 50's. He's short, has dark brown hair that was slicked back and at times he came across like a mob hit man. He started off by giving his stats: Det.220, forensic investigator, 25 and a half years, joined Jan. 3rd 1983. 14 years on crime scene unit.

Linda Weinman starts off by asking him question about crime scene unit (csu). Bello testified that he arrived at Nixzmary's apt. at 6:25 am, no civilians present and he made a sketch of the apt.

Bello steps off the witness stand and goes to his right, by the jury box, to look at an easle with a photo of the sketch he made of the apt. Bello explains layout of apt to jury. Sanchez and Mullin move over to prosecutor's table to get a better look at the easle with the picture of apt sketch on it. A guard then moves Nixzmary's chair from off the evidence table and puts it on the floor. The evidence table is directly in front of the prosecutor's desk. Bello is using a pointer. He said the kitchen had a stove, a washer and a dryer. Master bedroom set up for 5 people, including 2 cribs

Bello also described a junk storage room (Nixzmary's room) that had 6 matresses piled high, bicycles, shopping carts, chairs and tools.

Weinman then asks Bello if he took measurements of the apt. Weinman asks the distance between bedroom 3 (Nixzaliz's room) and bedroom 1 (the kid's room where Nixzmary was found dead). Bello answers 30 feet.

Bello then steps off the witness stand, has a tape measure and goes from the jury box to the other end of the room. When he gets to 30 feet, a red tape is put on the floor to mark the spot. He does this with all the other measurements Linda Weinman asks him about. Bedroom 3 to bathroom = 26 1/2 feet. Bedroom 3 to kitchen = 13 feet. Kitchen area to bedroom 1 = 8 feet. Bathroom to kitchen = 5 ft. 4 inches.

Bello then testifies that in bedroom 1 (the other kids room) that there were 2 beds made along the west wall and on the floor closest to the south wall, the victim was lying face up, feet closest to the wall. Her head was resting on a red sweatshirt ( and lavender top) and she was lying next to a small kids play table. ( the top of the table was yellow and the legs were blue) Bello also noted that on the table was a purple Jello pudding with the spoon still in it. (Nixzmary actually took a strawberry Jello pudding and when you look at the photo the color of the pudding appears pink, not purple. There's a pack of Strawberry Jello Pudding still in the refridgerator that was photographed. Cesar is the one who called the Jello "yogurt" but it was really Jello pudding. The DA's office even confirmed this some months ago but still continue to call the substance yogurt instead of pudding. BELLO, HIMSELF, NOTED THAT IT WAS JELLO PUDDING)

Weinman then put up two crime scene photos that Bello took up on the projector screen in the courtroom. The gigantic white screen is on the right hand side of the courtroom. There are two televisions placed on both sides of the room so the audience can see what's on the screen.

One photo was of little Nixzmary lying on the wooden floor. She's naked from the waist up and only wearing red sweatpants. Under her head is bundled her lavender top and red sweatshirt. She's got 2 black eyes, (raccoon like) that encircle her whole socket. Her face is disfigured and sunken in. Her mouth is slightly open, her shoulder bones are jutting out, (similar to an Aushwitz victim's) and her hip bone is sticking out (like an Aushwitz victim) Her red sweatpants are hanging off of her to the left of the picture. Her right hand is lying on her chest and her left hand is lying on the floor. Her hair was pulled back into a ponytail. (this photo is haunting and disturbs me more than the autopsy pics. It looks like a corpse that was lying on the floor dead for days instead of a child that just died.)

The second photo put up was that of Nixzmary lying on the floor next to a bed with a blue comforter to her right and a children's table to her left. The table was yellow on top and the legs were a dark blue color. The table has the Jello pudding with a spoon still in it. To the left of the Jello Pudding cup was a purple box. (It looked like a children's plastic crayon box to me)

Then Weinman put up on the projector people's evidence 18, 19, 20, and 21. People's 18 was a photo of Nixzmary's left ankle with the ligature mark from being tied to the chair. The ligature mark was deep and triangular shaped with the point going to the right.

Photo 19 was a picture of Nixzmary's chin and neck. There's a gigantic scab on her chin and around her neck are two lines. Bello said she had a "nice cut on her chin". I said "NICE?" outloud, then Sanchez and Mullin both objected to his using the word "nice". The judge told him to just say what the picture is. The two long lines around Nixzmary's neck were scrapes.

People's 20 was a photo of her back and buttocks. There were 6 purple circular bruises going down her lower back.

People's 21 was a photo of her buttocks. There was two bruises on the right buttock, a bruise on the left buttock.

Weinman handed Bello a search warrant and Bello says that Justice Michael Brennes(?) authorized it.

DiMango now pulls the lawyers out into the hallway behind her bench.

Nixzaliz is crying, wiping her tears with a white tissue.

Bello continues. He says "serology" is blood samples.

Bello then testified that after the search warrant, that he did a room to room search for evidence. A series of photos is put up on the projector screen and Bello says what evidence is in each of these photos.

The first photo labeled S1 was a possible blood sample on the wall of bedroom 2 (Nixzmary's room).

Bello points out that hers was the 45th crime case for year 2006.

Weinman gave Bello a photo, he steps out of witness box and mounts it on easle to his right.

Defense counsel, Mullin says rather than go through pictures one by one they have no objection to the pictures. Pictures handed to defense and defense only objects to photo called people's 43. DiMango says all photos in evidence except 43.

Bello walks over to the projector. Photos up. Peoples 52: photo of a yellow police ruler with an arrow in the middle pointing to a blood sample on the floor. The blood sample is where the door swings in bedroom 2 (Nixzmary's room).

People's 53: possible blood sample on 6 mattreses stacked high. (Nixzmary's room).

S4:litter box on the floor in bedroom 2 with feces in and on the side of the box.

S5: nylon rope in bedroom 2.

Bello walks over to the Nixzmary's chair that's on the evidence table and says he cut part of the nylon rope that was on the chair to test for evidence.

S6. Weinman picks up the yellow Donald Duck pillow stained with Nixzmary's blood, that's going down in a line, and shows it to Bello who's standing up.

S11: A photo that shows the base of the tub with possible human hair. Bello points to the hair up on the screen.

People's 30: photo of a red bucket out in the hallway outside of the bathroom. Bello said he took a water sample from the bucket.

S13: a comforter that was found in bedroom 2 (Nixzmary's room) it was white, with green lines and pink flowers. There was duct tape attached to it.

Peoples 32, S14: photo of a dark green kids sweatpants in the tub. It was all balled up and soaking wet with a possible blood stain on it.(remember "S" means serology and anything labeled S is police evidence and "peoples #" could be referring to the same police item only under different name that the D.A.'s office uses)

Bello points out that any item labeled with a "B" is considered "investigatory evidence" and is kept. (I forgot by who, the Medical Examiner or police)

Next photo, people's 33, B-2: photo of a chair by the radiator found in bedroom 2.

Photo: people's 34: a white door with a gold doorknob. Hanging down from the doorknob is a white nylon rope. Bedroom 2 (nixzmary's room)

People's 11. Weinman takes the doorknob from the evidence table ( their two doorknobs joined together, one to left and right, with white nylon rope hanging from it) and holds it up to show Bello. He identifies it.

People's 35/ B6:a photo of a bathroom trash can with balled up duct tape inside of it. The trash can was a pink color and the rim is shaped like a sunflower with half circles going all around.

People's 36 / B7 and B8: photos of a child's bluish green jelly belt with fashionable holes all around it and duct tape from bedroom 2.

Weinman picks up Nixzmary's belt from the evidence table and show it to Bello who confirms it.

People's 37 photo: a brown paper bag, brown rope, bungee cord and nylon rope.

Peoples 10: Weinman goes to the evidence table and shows Bello the bungee cord that was used to tie Nixzmary.

People's 38: photo of NIXZMARY'S ROOM. Bello describes this as a junk storage room. There's a bicycle, radio, carts ,fan, bins on the floor, chair and wood.
People's 39: the southern part of the storage room (Nixzmary's room): 6 mattreses stacked on top of each other, tool box, laundry, dresser ,kids motor car.

People's 40: photo of the kitchen: table, chair, stove, washer, dryer, computer bag and a printer.

People's 41: a photo of the inside of the fridge. The strawberry Jello pudding is still in the fridge. The fridge was filled to the brim with food.

Bello testifed that he gave all the evidence to Police Officer, Nolan, to voucher.

He said he was directed to go look for a fetus in a jar. He said he didn't find it because he was expecting to find a baby with a head, arms and legs in a jar. He went back to look and found the small jar filled with the clear liquid and a red glob of stuff inside it. The jar was a cinnamon jar.

Weinman put up a photo of the fetus in the jar. The Medical Examiner was notified and they sent a representative back.

Bello now puts up photos onto the easle and Weinman reconfirms how many feet the room were.

Defense lawyer, Sammy Sanchez, did the cross examination. Sanchez starts off by saying to Bello, "welcome to 320 Jay St. Brooklyn Supreme Court."

Bello testified that he joined the crime scene unit in Oct, of 1994 until Feb. 1st. of this year. He now works in the DNA unit of the police lab. He said when he first arrived at 571 Greene Ave. that P.O. Tarmey was guarding the 2nd. floor door.

Bello said he talked to Det. Sneider. Sanchez asked that as lead det, if it's Sneider's duty to create a file on the case and collect police reports? Bello: yes.

Sanchez started talking about the job of the first P.O. on the scene, Eric Nolan.

When asked what the master bedroom looked like, Bello replied that it had a double bed, cribs, fold up bed, wardrobe, desk, dressers, and room for 5 to sleep.

Defense lawyer, Kathleen Mullin puts photos of defense D&E up on screen. Photo of a crib that's yellow, dresser, wardrobe and radiator.

Sanchez mentions that the apt. was a railroad apt. that you could walk throught the rooms and says if you measure the apt. it's 41 feet.

Bello testifies that the items in the living room were: a computer, a tv, desk and chairs.

Sanchez mentions that if you're in Bedroom 3 (Nixzaliz's room) that you'd have to go through the living room. Bello: yes.

Mullin puts up 2 photos of the living room on the projector. (f & g in evidence) On one of the photos there are yellow shelves to the top of the photo, a computer in the middle and a TV on the lower right. There's a chair on the left.

Sanchez shows a photo of the red bucket and asks if it's fair to say that the bathroom and kitchen are in close proximity and the bucket was in between.

A photo put up of the bucket in corner between 2 rooms.

Sanchez then put up 2 more photos, def. exhibits I and j, both of the bathtub.

The first photo shows a white bathtub. The shower curtain is pulled to the right, exposing the tub.In front of the shower curtain is sink with a kids yellow cup that has a smiley face on it. (smiley face: two black dots for eyes and a black line in the shape of a U for the smile).

The second photo shows the inside of the bathtub. The metallic faucet that Nixzmary's head was hit on. There's also a gray snake-like pipe from the faucet head that goes up. In the bathtub, right underneath the faucet is another kids smiley face yellow cup. (it was strange for me to sit there and look at this kids smiley face cup lying in the bathtub. It's such an innocent token of childhood in a place where a horrific murder took place. Right above that smiley face cup was the faucet where Cesar bashed Nixzmary's head in)

Bello testified that when he got there, only P.O. Tierney who was safe guarding the door and Det. Ferrera was there.

He then explains that the squad detectives work 8-4 and 4-1. The night watch detectives cover the whole borough from 1 am- 8 am. When the squad detectives come in at 8 am they meet with the night watch detectives.

Sanchez then stated that Det. Ferrera was there to gather info, fill out police reports and guarantee a smooth transition between shifts. When Sanchez asked if Det. Ferrera's interview with P.O. Nolan would appear in the DD5 police report, D.A. Dwimoh objected. (probably because Sanchez previously impeached Nolan by citing his information in the police report 2 years ago doesn't match his current testimony. He said 2 years ago in a police report that Nixzaliz was crying and now he's testifying that she didn't)

Bello testified that he went to the Medical Examiner's office to identify the body.

Sanchez then states that most of the injuries to Nixzmary were on her back and he shows three photos.

One of the photos is of Nixzmary's lower back and buttocks. She's got a gigantic bruise on the left side of her back and bruises on buttocks.

He puts up a picture of the fetus in the jar and asks Bello did he see anything that resembled eyes or a human mouth. Bello: no. Then Sanchez says that anyone in their right mind wouldn't say that resembled a person.(the implication is that because Nixzaliz stated that she looked into the fetus's eyes and she called it a baby, that she wasn't in her right mind.).

The cross examination was stopped for lunch.

Testimony resumes after lunch. Judge DiMango wasn't wearing her robe. Just her dress throughout.

Bello testifies that he arrived on scene with his partner Det. Michael Cunningham.

Sanchez told Bello that Det. Ferrera arrived at 5:25 am. Bello testified that when he got there, Ferrera wasn't there and arrived afterwards.

Bello said he was done with his investigation at 12:45 pm.

Bello testifies Nixzmary found in southeast corner of room and chair similar to Nixzmary's was found in bedroom 1 (kids room).

He said he left the apt for the first time at 10:30 am and went to the crime scene office in Jamaica, Queens.

Sanchez asked him if he spoke with det, Kennedy and det. Snyder and whether he took courses with the FBI since alot of the evidence deals with blood. Bello answered yes that he took a two week course and a one week course.

Bello said he went back to the apartment for the second time with the warrant to go room to room.

He said Nixzaliz's room was cluttered, books but no blood.

Sanchez asked him if he picked up bubbles in the tub. Bello: no but there was sweatpants w/poss. blood in the tub.

Bello said that the kitchen was normal but tight, items recovered from the kitchen were a retractable razor knife and duct tape.

Bello said living room was normal.

Says first bedroom he entered was bedroom 1 (kids room where Nixzmary found) and that there were blankets and pillows that had possible blood.

Sanchez then picks up Nixzmary's clothes (red sweatsuit and lavender top) without gloves on. (everyone else wears gloves when they handle little Nixzmary's clothes as if they're going to catch some disease if they touch it with their bare hands. Sanchez and Mullin don't wear gloves when handling little Nixzmary's clothes) So Sanchez picks up her clothes from the evidence table and asks Bello to identify it. He does. When he held it, he was bunching it up and when he put it back on the table he didn't fold it. (probably because he's a man and doesn't know any better)

Bello said the beds in the kids room were nicely made but 2 blankets and a pillow had possible blood and most of the blood was found in bedroom 2 (Nixzmary's room).

He said the second time he got to the apt was 1:10 pm.

Bello said he lifted blood samples by using a sterile Q-tip in a drop of distilled water and swab. It's then put into a paper bag so it can breathe and given to P.O. Nolan at the precint to voucher.

He said S1-15 going to ME's office and B1-9 remain as property.

When Sanchez shows Bello a photo of Cesar's black belt, Bello says he's not familiar with it and Det. Pantollo would know.

Sanchez started asking if Cesar and Nixzaliz were mouthswabbed and if Cesar's jeans with bloodstained removed. Bello said that Nixzaliz's nails were not cut or scraped for evidence.

Bello said he only knows the results of some of the DNA tests.

Judge gives everyone a 3 min. break.

Asst. D.A., Linda Weinman, did the re-direct. Weinman asked Bello if the stereo in the living room was working and Bello said he never played it.

Then Weinman puts up a photo of Nixzmary's lower stomach area. You see her belly button and underneath the red waistband from her sweatpants.

Then Weinman puts up the original crimescene photo of Nixzmary on the floor.

She references a white pillow with blood in room Nixzmary found in.

She shows him the physical duct tape again.

She asked him what was recovered in the bathroom. Bello says hair in the tub, blood on a towel on the rack, green sweatpants with possible blood.

Weinman then says that there's a jagged edge to the bathroom sink that's missing.

She asks him a distance question. Then his testimony ends.

Afterwards, the prosecution called their second witness, a DNA expert, Taylor Dickerson. Asst. DA, Linda Weinman did the direct examination.

At this point, the sargent in the room, a tall light skinned, black guy, tells two female television reporters that they have to leave the room with him. He starts grilling them out in the hall about what they were laughing at. (it was a slow moment and the two normally sit together and chat even during Cesar's trial) These two reporters are the main reporters that have been covering this case everyday. Even the lead D.A. turned around and looked when the reporters were no longer in the room. When they came back in, they choose to sit in the back row as opposed to the front row where they were sitting.

Anyway, the DNA expert, Taylor Dickerson, was white, late 50's, and had gray hair. He stated he was employed for 4 years at the office of the Chief Medical Examiner and that he's a criminalist - level 4. He performs DNA tests and writes out reports. He has a degree in Forensic Science. Dickerson also stated that he's currently working with the World Trade Center DNA forensic group.

Weinman requested that Dickerson be qualified as an expert in forensic biology and DNA analysis. DiMango granted it.

Weinman started off asking questions about people's DNA.

She then asked him about the Medical Examiner's case # K06-183, Nixzmary Brown. Nixzmary's blood was received on January 12th., 2006 and was tested and compared to other blood profiles.

Dickerson then goes on to list a number of items that were tested for blood and DNA. The items of property he received on Jan 14th- N023719 - swab 51b22. The items were: clear plastic, litter box, rope from chair, yellow pillow, blue blanket, marroon blanket, white pillow, blue towel, possible hair, water sample, comforter, sweat pants, towel from bathroom towel rack, jeans, black marroon underwear and 4 pairs of socks. Other items that were tested were: orange scissors, nail clippings from Cesar, knife, chair, bungee cord, duct tape, Nixzmary's blue belt, radio, and oral swabs from Cesar.

On Jan. 25.th, 2007- three strips of duct tape from blanket and a swab of duct tape pieces.

On Feb.28th. 2007, they received oral swabs from Javier Batista.

March 8th, 2007, oral swabs from Cesar's two kids and Edwardo.

Dickerson said that Nixzmary's DNA profile was found on bloodstains that came from the wall and floor and on a litterbox.

Weinman shows him a photo on screen of the litterbox and Dickerson says he took the photo of the blood stains and points to where the blood stains are.

Nixzmary's DNA also matched blood found on a yellow Donald Duck pillow and a blue towel from bedroom 2 (Nixzmary's room).

Blood found on a white pillow from bedroom 1 (kids room) contained both Nixzmary's and Edward's blood.

Dickerson stated that human DNA was found on rope (white twine from the chair) and the DNA matched Nixzmary.

Dickerson also stated that feces was found in the litterbox and one of the DNA profiles matched Nixzmary Brown.

Weinman then put up on the projector screen a photo of all 46 pieces of feces for the whole room to see. (now, I just wrote about the feces because everyone already knows that this poor child was forced to use a litterbox so I'M NOT SAYING ANYTHING NEW, but Linda Weinman putting a picture up on the screen of all 46 pieces of feces recovered from the box, infuriated me!!! I sat there and thought 'how low can you stoop to win a case?') Afterwards she mounted the picture on an easle to the right of the jury.

Dickerson went on to list more objects that Nixzmary's blood was found on: blood on a comforter in 5 different locations from bedroom 2 (Nixzmary's room), blood on sweatpants, 2 blood stains on a pink towel, blood stains on jeans in 7 different locations.

There's a bench conference and both parties agree to a stipulation.

On Cesar's jeans, blood was found on the legs, the front and the back.

Left hand nail clippings of Cesar, blood found that's a mixture between Cesar and Nixzmary.

Nixzmary' s blood also found on her blue belt.

Human DNA was found on duct tape. The dna was a mixture and they were unable to determine who's DNA it was but Nixzmary could be a contributor.

On another roll of duct tape, Nixzmary's DNA was found. On another piece of duct tape, there was human DNA that belonged to Nixzmary. 3 strips of duct tape were removed from a blanket and the DNA matched Nixzmary. There was also blood on the blanket.

Cesar's black belt was swabbed in multiple areas and the DNA came back belonging to Edward Brown. The other person who's blood was on that belt was unknown. ( 4 samples were taken from the belt.)

Dickerson stated that because there was no unknown female profile, there was no blood taken from Nixzaliz. Only DNA from Cesar, Edward and Nixzmary.

Then Weinman asks Dickerson, that he has no way of knowing who handled the litterbox and who put the towel on Nixzmary etc.

Defense lawyer, Kathleen M. Mullin, did the cross exam.

Mullin started out by saying that Dickerson never found a mixture with Nixzmary and an unknown female profile so had no reason to request Nixzaliz's blood.

Mullin pointed out that when Dickerson began work on this case he was a criminalist 2and she goes over his qualifications.

Mullin puts up a photo of Cesar's black belt (defense L) on the projector, then she starts writing on a gigantic pad mounted on an easel.

Mullin confirms that Edward's DNA was matched definatively on the belt and other areas couldn't be matched.

Mullin shows Dickerson some photos. He says he recognizes the jeans, shirt and pullover.

Mullin puts photos on projector of jeans and black sweatshirt. Mullin blows up the portion of the photo of Cesar's jeans. On the upper right leg of the jean, on the thigh, is a gigantic blood stain the size of someone's palm!

Mullin points out that Dickerson never had occassion to ask for the clothing or nails of Nixzaliz because no unknown female blood was ever mixed with Nixzmary's. (This implies that Nixzaliz wasn't involved with beatings to the point of blood being spilled)

Mullin shows him a photo of the green sweatpants found in the tub and points out he can't tell the age of the blood, that the blood could've come from a single beating.

Mullin asked about the blood on Nixzmary's blue belt.

White pillow found in bedroom 1 (kids room) identifies 2 children: Edward and Nixzmary.

Mullin pointed out: there was no sample unaccounted for when you finished. NOT A SINGLE MIXTURE OF NIXZMARY'S BLOOD AND AN UNKNOWN FEMALE CONTRIBUTOR.

Testimony ended.

After court was over Judge DiMango said to the media in the room that if they were going to photograph evidence to raise their hand. Four photographers came in and walked over to the evidence table in front of the prosecutor's desk.

The two reporters who were escorted out of the room earlier, angrily walked over the prosecution's desk where DiMango was standing and confronted her about being escorted out earlier.

Lead D.A. Ama Dwimoh put on hospital gloves and started unfolding Nixzmary's red sweatsuit out onto the table so the photographers could photograph it.

The Judge was standing right there as the media was taking pictures. It was the Daily News, El Diario, I think channel 11 and I'm not sure about the other one. The TV stations NY1 and NY1 Noticias was also there taking photos of the evidence.

Two media outlets took photos of the feces that was mounted on different easles. They probably didn't know what it was they were taking the photo of. NY1 and NY1 Noticias, whose reporters were in the room and knew what it was, decided not to have the photographers take photos of it. (thank god, at least they were decent).

Some of the people who work for the court were coming over and staring into the litterbox. It made me mad. Nobody goes over to their house and stares into their toilet bowl.

After the media had finished taking their photos and everyone left the room, I decided to stay behind. Little Nixzmary's clothes were still layed out on the table and I didn't want to leave her alone. Her red turtleneck shirt, her red sweatpants, her lavender shirt. I didn't want to leave her alone with those court workers in the room who couldn't care less about her. To them all she is a famous case. This is the little girl that I love, this is the little girl that I visit once a month. I didn't want to leave her alone. So I stayed with her. I watched as the female guard folded her little red sweatpants in half then folded it again, lengthwise. She put it in the silver cart. She packed up all the evidence and put them back into the cart. She put the torture chair on top of the cart and rolled the cart over to the door in back of the judge's bench. Then she was gone and little Nixzmary went with her.
