Nixzmary Mom Trial, Day 10: Upstairs Neighbor Impeached Twice!

September 26th., 2008 was the 6th day of testimony in Nixzmary Brown's mother, Nixzaliz Santiago's, murder trial. First I'll say what happened in a nutshell, then I'll go into detail over the testimony.

HERE'S WHAT HAPPENED IN A NUTSHELL: The prosecution called Ulbis Rivera to the stand. She's the upstairs neighbor who's phone, Nixzaliz ran to get, when they discovered that little Nixzmary was dead. The defense impeached Rivera twice.

First she told them that Nixzaliz NEVER confessed to her that Cesar would beat her. Defense counsel, Kathleen Mullin pointed out that Rivera gave an interview 2 years ago to the newspaper, the New York Daily News. The article was called The Awful Lies At Death's Door where Rivera tells the reporter that Nixzaliz DID confess to her that Cesar would beat her.

The second issue she was impeached on is when she stated that Nixzaliz was only knocking on her door. Mullin pointed out that Rivera told Detective Scandol, 2 years ago, that Nixzaliz woke her up when she was banging on Rivera's door.

Rivera also stated that she saw Nixzmary on Christmas and she never had any bruises on her.

When the 911 tape was played in the courtroom, Rivera said she thought Nixzaliz was faking the crying because when Rivera got off the phone with 911, the crying stopped.

Rivera also broke down in hysterical tears after seeing a photo of Nixzmary on the floor.

HERE'S THE TESTIMONY IN DETAIL: Before everyone arrived, the Judge, Patricia DiMango came into the courtroom from the public door that everyone uses to get in! People were shocked when they saw her coming in from that door. She said "I've been re-routed and re-routed and re-routed."

The judge was wearing a white sleeveless shirt, and large circular earrings. Since jury selection, the Judge has had a cold. When she got on the stand, she was still coughing and blowing her nose. Lead D.A., Ama Dwimoh(ja-mo) was wearing a sky blue jacket and a black skirt, Asst. D.A., Linda Weinman, was wearing a dark brown skirt suit, Asst. D.A. Anthea Bruffee, was wearing a teal blue suit, defense lawyer, Kathleen M. Mullin, was wearing a light gray suit. Nixzaliz was wearing a lavender sweather with a ring of purple around the collar and sleeves, navy blue jeans with designs on the back pockets. Her hair was in a bun and on the bun was a purple bun holder that encompasses the whole bun. In the middle of the bun holder was a sunflower. She was wearing black rimmed glasses.

Indictment 348-2006 on the calendar.

The first witness was Ulbis Rivera, the upstairs neighbor whose phone Nixzaliz ran to use when she found Nixzmary dead. Rivera was short, wearing a black suit with a white shirt, a black bag around her left shoulder and glasses.

DiMango asked Rivera if she would be more comfortable with the Spanish interpretor, Rivera said yes. The judge told Rivera if she uses the interpretor, not to go back and forth between English and Spanish. The translator, Migdalia, who's tall, late 40's, hair in a pony tail, stood beside Rivera. The judge has her black robe off. Lead D.A., Ama Dwimoh did the direct exam. Rivera testified that on Jan. 11th. 2006, she was living at 571 Greene Ave, on the third floor, that she knew Nixzmary and her family who had moved there just 9 weeks before she did.

Dwimoh then wants to enter into evidence Nixzmary's graduation picture with her wearing a white robe and holding her graduation cap. This is a famous picture of Nixzmary from when she was 5 years old. The defense objects, there's a bench conference, and the judge allows in the picture.

Dwimoh then puts the 5 by 7 picture of Nixzmary up on the projector that flashed the image onto a gigantic screen on the right hand side of the room. It was surreal when that picture was up on the screen. It was like Nixzmary,herself, was looking at all of us. Was watching her own mother's murder trial. The whole courtroom grew silent. This was the owner of the clothes that were spread out on the evidence table. It was like she was there herself, in the courtroom. It was surreal. I'll never forget it.

Dwimoh asked Rivera if that was how Nixzmary looked when she knew her. Rivera said yes. Rivera testified that she was lying down sleeping when at 4:15 am she heard someone knocking on her door.

It was Nixzaliz who was dressed in white and wearing white sneakers.

She said: come downstairs because my baby, my girl, has drowned. Then Rivera corrects the Spanish translator by saying: not girl, she said baby.

Rivera said that Nixzaliz's demeanor was calm.

Rivera told her daughter to watch because she was going with Nixzaliz downstairs.

They went to the room in the back and Rivera said she saw a baby, a girl's body on the floor. Rivera said that Nixzaliz was still calm.

Dwimoh asked her if from the time she knew Nixzaliz, did she appear any different in that moment, and Rivera said, no.

There's a bench conference and DiMango said she's calling a brief recess. The reason for the recess was that Nixzaliz's lawyer, Sammy Sanchez, wasn't feeling well. It was said, and this can't be confirmed, that he had a mini heart attack. Someone said they saw him immediately go to an ambulance parked at the side of the courthouse. After he comes back into the building, when him and defense counsel, Kathleen Mullin, were in the halls and a reporter approached them, Mullin screamed like an Irish banshee, "LEEEEEEAAAAAVE UUSS ALOOOOOOOOOONE!!!!!!" I was still in the courtroom when all of that happened out in the hall but the reporter who Mullin screamed at came back and told us.

When Sanchez and Mullin come back into the room they start having friendly conversations with Ama Dwimoh and Linda Weinman and Sanchez shows them something on his cellphone. They were all talking in the jury box, closest to the audience, chatting it up.

When court resumes, Rivera was accompanied by a black man. I think he works for the D.A.'s office and accompanies witnesses to the courtroom.

DiMango told the jury that even though some of them might possibly speak Spanish, to only listen to the court interpretator's version of what Rivera is saying.

Rivera said that three children were in the livingroom.

When she got to the bedroom she saw a baby on the floor. It was Nixzmary. Cesar was pressing on Nixzmary's chest and Nixzaliz was in back of him by Nixzmary's head. Rivera said that the other kids were now in the room with Nixzmary, that they were looking at her "with eyes wide open as if to say help me". She said that the kids were afraid and frightened. Rivera said Nixzmary had no pulse, she wasn't breathing and she was "cold as ice".

Rivera asked Nixzaliz what happened and Nixzaliz said that Nixzmary drowned. Rivera asked "why is the girl dressed and dried?" Nixzaliz said that she took Nixzmary out of the bathroom, dried her and dressed her to help her. (When Cesar was initially doing CPR on Nixzmary, some water came out of her mouth and Nixzaliz stated that she thought that when she put Nixzmary in the tub of water and put water in her mouth, that Nixzmary drowned from it. Obviously, she's not the brightest bulb in the box)

Rivera asked, "what happened to her face?" and Nixzaliz responded that she did it to herself.

When Rivera asked Nixzaliz about the drowning and why Nixzmary was not wet, Cesar then took Nixzmary's shirt off.

Rivera said when she asked them if they called the police or ambulance, Nixzaliz said no.

Rivera stated it looked like Cesar was only pretending to give Nixzmary CPR. She said he looked like he was "making believe".

At this point, Rivera starts crying on the stand.

She said Nixzmary's hair wasn't wet, she was dry and there was no water on the floor.

The children left the bedroom.

Rivera told Nixzaliz to go upstairs to her apt and get the phone.

Nixzaliz came back down with Rivera's daughter's cell phone, 911 was already on.

Rivera said when she got on the phone with the 911 operator, Nixzaliz , who was by Nixzmary's head started crying, and wailing but there were no tears. She said when she got off the phone, the crying stopped.

D.A. Dwimoh asked her if prior to her testimony here today, if she listened to the 911 tape and if it's accurate. Rivera said, yes. Dwimoh then instructs one of her assistants to put the tape into a computer to be played. There's some problem and it won't play. Finally, they get it to play.

(I don't have the exact conversation word for word. A word or two might be missing from the sentences. I was taking notes as fast as I could) In the beginning of the tape, you hear people talking in Spanish. Rivera: please send the police here. Operator: where are you? Rivera: I'm at Greene Ave. 571, Brooklyn, Yes I'm here, there is a girl dead here. (Nixzaliz is crying in the background) Operator confirms the address. Rivera: second floor apt, I'm calling from my cell. The lady went up to my house. The little girl drowned in some water. She's all black (her eyes) (Nixzaliz crying in the background, saying mi miha, mi miha--Spanish for "my daughter") Operator: for yourself? Rivera: it's for a little girl laying dead on the floor. Operator asks how old she is. Rivera: 7 years old. Operator: 7 years old and she's not breathing? Rivera: no pulse, no nothing. Operator: anyone doing CPR? Rivera: yes. Operator: continue with the CPR.

Rivera again stated on the stand that when she got off the phone, Nixzaliz stopped crying.

Police arrived a short time later.

After officer arrives, he looked at Rivera, she shakes her head at the officer in the room (she's still crying on the stand) She said he looked like he was going to cry too.

Children now out of the room.

After EMS came, everyone was asked to step out of the room.

Rivera went into the kitchen with Nixzaliz, Cesar went into the living room. The 3 older kids were with Rivera and Nixzaliz, the 2 babies were in Nixzaliz's room.

Rivera said the police were respectful.

At this point, Nixzaliz is crying in the courtroom. She's got white tissue to her eyes.

Rivera testified that Nixzaliz and Cesar were not scared.

Cesar left the apartment with the police, he wasn't handcuffed.

Nixzaliz was left in the apartment and the police said they were taking all 5 kids to the hospital. Nixzaliz told them not to take the babies because they could not sleep without her. Rivera helped to dress the babies and the other 3 older kids in their sneakers and coats. Rivera said the baby's clothes were in Nixza's room."Nixza" was what she called Nixzaliz.

Rivera said Nixza became worried because she didn't want the police to take away the two babies and she said "my boys, my boys!"

There's now a bench conference. Rivera has her hands to her head on the stand as if she's in mourning and in pain.

During the bench conference, a well respected reporter came over to talk to someone and this gung-ho black sargent started yelling out, "no talking in this courtroom!" (not all of them are like this, thankfully, but some of them are assholes who are on power trips. My guess is that this black guard was probably intimidated by all of the influential reporters in the room and was just trying to make himself feel more important. It's pathetic, really.)

Dwimoh asked Rivera which of the children Nixzaliz was referring to when she said "my boys, my boys". Rivera said the 2 babies, Cesar Augustine (18 months) and Cesar Gabriel. (6 months)

Rivera said two detectives picked her up and took her to the precinct.

She said she spoke to the D.A.'s office there, was there for a long time, and was treated with respect. She said she spoke in English, was uncomfortable, but said "I had to say what I had to say".

Rivera is asked to identify the mother of Nixzmary in the courtroom. She says she sees her. Dwimoh asks what color she's wearing, Rivera responds that she's wearing purple then points her finger towards the defense desk.

Rivera testified that she got home on Jan. 10th 2006 around 9:30, had to walk past Nixza's apartment and heard nothing. She stayed up watching the news and went to bed at 11:30pm. She said Nixzaliz knocked on her apt. door at 4:15 am.

Then the D.A. shows Rivera a crime scene photo of Nixzmary dead on the floor of the apartment. The photo is of little Nixzmary lying on a wooden floor. She's naked from the waist up, wearing only red sweatpants that are hanging off of her to the left of the picture. She's so thin that her whole body fits into half of the sweatpants. Her lavender top and red turtleneck sweather are bunched up under her head as a makeshift pillow. Her face is a ghastly white color, it's sunken in and hollow from being emaciated. She has two black eyes, raccoon-like that encircle her entire eye sockets. There's a gash over her right eyebrow, her mouth is slightly opened, her shoulder blades are jutting out, you can see the bones through her skin, her right hip bone is sticking out like an Aushwitz victim. Her right hand is across her chest and her left hand is sprawled out onto the floor. (This picture is really haunting. It bothers me more than the autopsy pictures. After Cesar's trial, sometimes at night when I'm lying in bed, I see it in my head, and it's really disturbing.)

So, a female guard hands Rivera the crimescene photo.

Upon seeing the photo, Rivera breaks down in hysterical tears, the tears are pouring out of her eyes, her face starts turning blood red, she starts waving her hands back and forth as if to say "no". She was having a nervous breakdown on the stand upon seeing the photo.

The D.A. told her to give the photo back to the guard.

They offer her some water and she drinks it.

Dwimoh asked her if the photo accurately depicts what she saw that night. Rivera said, yes.

After her testimony ended, she walked off the stand was still crying as she left the room. As soon as she exited the courtroom doors, she was wailing outloud. It was sad.

Defense lawyer, Kathleen Mullin, did the cross exam.

Mullin requested that the 911 tape be replayed. She asked Rivera, "are you ok?" "si" responded Rivera (spanish for yes)

Mullin asked her if she believed Nixzaliz was faking and said that her and Nixzaliz were not very good friends. Rivera said yes, she thought Nixzaliz was faking and even though they didn't go out together, they did spend time together.

Mullin asked her: did you give Nixzaliz a reason to believe that you would lie for her? Rivera said, no.

Mullin pointed out that RIVERA DIDN'T BELIEVE NIXZALIZ WAS FAKING IT WHEN SHE CAME TO THE DOOR. (I think Mullin is trying to say that if Nixzaliz was going to fake it, then she would've started faking it at the door) Rivera confirms that she didn't think at the door that Nixzaliz was faking it.

Mullin says: you can hear Nixzaliz crying on the tape, you hear her saying "my baby". Rivera says, "si" (yes)

Mullin says: you hear her on the tape today saying "mi mijos". Rivera said, yes. Mullin said you heard her say that on the night you made the call. Mullin points out that "MI MIJOS" MEANS "MY CHILDREN". Rivera acknowledges that. (I think this means that EVEN THOUGH SHE SAID "MY CHILDREN" ON THE BACKGROUND OF THE 911 CALL, SHE WAS REALLY REFERRING TO ONE CHILD - NIXZMARY)

Rivera testified that when the first P.O. on the scene, Eric Nolan got there, her and Nixzaliz were still in the room with Nixzmary and left the room when the paramedics arrived.

Mullin confronted her about her statement that Nixzaliz was not in a frantic state of mind. Mullin asked her: YOU THINK THAT THE P.O. WHO CAME HERE AND TOLD US NIXZALIZ WAS IN A FRANTIC STATE OF MIND WOULD BE WRONG?

Mullin asked her why, if she thought Nixzaliz hurt Nixzmary, would Rivera allow Nixzaliz to touch the other kids who were in the kitchen with them. Rivera responded that she can't remember if Nixzaliz touched the other kids.

Mullin asked her if when she saw Nixzmary on the ground, if she smacked Nixzaliz in the face and screamed "WHAAAAAT DiiiiiD YOOOOOOU DOOOO TOOOO THAAAT GIRRRRRRRRL? TEEEEELLLLL MEEEEEEE"!!!!!??? Rivera denied this.

Mullin asked Rivera if she's from Puerto Rico. Rivera said, yes. Rivera couldn't say what part of Puerto Rico Nixzaliz is from.

Mullin asked her if she' familiar with the common Spanish spoken by Puerto Ricans. Rivera said, yes. Mullin said "LOS NINOS" MEANS "ALL CHILDREN". SHE SAID "ALL CHILDREN" CAN BE BOYS AND GIRLS" Mullin pointed out that today Rivera said that Nixzaliz said "mi ninos" (I think she pointed this out to show that Nixzaliz was not only just concerned with Cesar's kids, but with all of her children, including Nixzmary)

Mullin pointed out that 48 hours after the incident on JAN. 13th. 2006 RIVERA TESTIFIED AND NEVER TOLD ANYONE THAT SHE THOUGHT NIXZALIZ WAS FAKING IT. Rivera said that no one asked her.

Mullin pointed out that RIVERA WAS AT THE POLICE STATION FOR HOURS, MET WITH DET, SCANDOL AND MS.WEINMAN AND NEVER TOLD THEM THAT NIXZALIZ WAS FAKING IT.

Mullin then confronts Rivera about her statement that when Nixzaliz came to her door that she was only knocking on it. Mullin said that RIVERA IS NOW TESTIFYING THAT NIXZALIZ WAS KNOCKING ON HER DOOR BUT 2 YEARS AGO AT THE PRECINT, SHE TOLD DET. SCANDOL THAT NIXZALIZ WAS BANGING ON HER DOOR. Rivera said she never said that.

BOOOOOOOM! BOOOOOOOM! BOOOOOOOM!

Mullin took her fists and started banging on the side of the jury box! I jumped in my seat when she did it. It startled the whole room. I can only imagine what the jurors felt. The sound reverberated throughout the room! It was a scene right out of Law and Order, right out of Matlock! It was courtroom drama! She did it to demonstrate how Nixzaliz was banging on Rivera's door, as opposed to just knocking. I think the reason she's pointing out the difference is because if someone is banging on the door, it shows that they care whereas if someone is just knocking it appears that they don't care. (later on in the defense's case, Mullin will subpoena Det. Scandol to say that, yes, Rivera said that Nixzaliz was banging on the door and not knocking)

Mullin asked her if NIXZALIZ SAID TO RIVERA TO COME DOWNSTAIRS, THAT SHE THOUGHT HER --BABY--HAD DROWNED. Rivera said, yes. (Mullin is trying to show that when Nixzaliz says "baby", she could also be referring to Nixzmary since she referred to her as "baby" at Rivera's door)

Rivera confirmed that she complained to Nixzaliz about the screaming and the noise and that the fighting was covered up with music and the fighting was all of the time.

Rivera said she once saw the children in front of the building and they hugged her. She confirmed that she saw no reason to call ACS.

Mullin asked her if she called the ambulance in Nov. 2005 for Nixzaliz because of the violence in the house. Rivera said yes she called the ambulance, but not because of violence.

Mullin asked her if Nixzaliz came to the door and told Rivera and her daughter Esta that Cesar had pushed her and she lost the baby. Rivera said no, that Nixzaliz only said that she fell.

(Rivera is also saying that Nixzaliz never confessed to her that Cesar would beat her.) Mullin then asked her about her face being on the photo of the Daily News. Mullin confronted her THAT 2 YEARS AGO SHE GAVE A INTERVIEW TO THE DAILY NEWS WHERE SHE SAID THAT NIXZALIZ DID CONFESS TO HER THAT CESAR WOULD BEAT HER.

Dwimoh objects and there's a bench conference.

When Mullin asked her if she heard them fighting and heard things banging against the walls, Rivera said, yes and confirmed that she counseled Nixza to leave Cesar.

Mullin then showed her the photo of the fetus in the jar. Rivera said it's not a baby and denied telling Nixzaliz not to keep it. It was tissue from a miscarriage.

Rivera said that after the paramedics arrived that she showed it to the paramedic and he told her to leave it there. She left it on the computer table.

Rivera said that on the night Cesar took Nixzmary to the hospital for the gash over her head (Nixzaliz was already in the hospital for her miscarriage) the rest of the children were staying with her. Cesar came to Rivera's door without Nixzmary and wanted to take the kids. Rivera wanted them to stay with her because they were sleeping but Cesar said no and took them.

Mullin got Rivera to say that when Nixzaliz was gone into the hospital she heard no fighting downstairs, but when Nixzaliz came back home, the fighting resumed. (Mullin is trying to point out that there was domestic violence in the home, despite the fact that Rivera claims there wasn't) Mullin is trying to show that Nixzaliz was so afraid of her husband because he would hit her that she was powerless to help her daughter.

RIVERA CONFIRMED THAT ON CHRIRSTMAS DEC. 25th SHE CAME DOWNSTAIRS TO GIVE THE KIDS CHRISTMAS PRESENTS, SAW NIXZMARY AND SHE DIDN'T HAVE ANY BRUISES ON HER. Mullin pointed out that this was only 14 days prior to Nixzmary's death, that she had no injuries.

Rivera confirmed that in the 3 years that she knew Nixzmary that she was always skinny.

Judge DiMango is on the bench without her judge's robe on, wearing a white sleeveless shirt.

Mullin then goes over to the apartment layout chart and asked her where her room was in relation to the rooms downstairs.

Rivera also confirmed that she still lives at the apartment.

D.A. Ama Dwimoh did the re-direct.

Rivera said that at the end of Nov. when Nixzaliz appeared at her door, she was crying and afraid, and said that the day before she had miscarried and that she had fallen.

Dwimoh asked if Nixzaliz told her that Cesar caused her to have a miscarriage and Rivera said, no. (Dwimoh is trying to make it look like there was no domestic violence in the home and Cesar never beat Nixzaliz--which is the opposite of her strategy at Cesar's trial)

Dwimoh asked her if Nixzaliz was showing (pregnancy) Rivera responds, "no, she's heavy". Dwimoh snidely remarks, "apparently". The defense never objected to the remark.

Rivera testified that when she went to Nixzaliz's apartment she showed her something on a piece of toilet paper. She said it looked like when you have your period and you have clots.

The ambulance arrived and Nixzaliz was bleeding from her private area.

Rivera said she saw no injuries and left the clot (fetus) on the table.

She said the same day Nixzaliz went to Woodhull hospital, she (Rivera) took Edward, Selena and the two small babies to her apatment.

She said Javier was in the hospital.

Nixzmary was also taken to hospital by Cesar for the gash on her forehead.

When Cesar picked back up all of the kids, Nixzaliz was still in the hospital.

Rivera said at the precint, she was mainly walking back and forth, didn't talk to police the whole time she was there, and spoke to Asst. D.A., Linda Weinman many hours after she was there. Rivera said she never told the police that Nixzaliz killed Nixzmary because it was only what she thought and no one ever asked her. She also said she never saw Cesar do anything to Nixzaliz.

Rivera said that once she and Nixzaliz were on the steps talking, Cesar came, Nixzaliz got upset. Rivera said Nixzaliz called Cesar a name. Dwimoh asked what name Nixzaliz called Cesar. Rivera said, "do I have to say it outloud?" Dwimoh said, yes. Rivera said "CABRON" The Spanish interpretator, Migdalia, looked uncomfortable then started smiling. The other interpretator, Jeanette, at the table with Nixzaliz started smiling too. The interpretator said the word meant "son of a bitch". Rivera said that in Spanish it is a very ugly word.

Rivera also said that when she heard fighting it would only be Nixzaliz's voice, not Cesar's. (they're trying to make it look like Cesar was not the one fighting, it was Nixzaliz, so the jury doesn't think there's domestic violence on Cesar's part)

Rivera said that "los ninos" refers to children in general and not necessarily male children.

Rivera said that when she told Nixzaliz to leave Cesar that it was not because Cesar was hitting her. She said she counseled Nixzaliz to leave him because Nixzaliz was complaining that Cesar wasn'g giving her any money to buy things for the kids, and about his hours of work.

Rivera also said that when she saw Nixzmary on Christmas, she had clothes on and she did have the gash over her eye.

Rivera said that Nixzaliz would come to her apartment almost everday and they would talk about magazines. Dwimoh asked her if Nixzaliz could read, Rivera answered that she didn't know.

Rivera said that when she first moved in Nixzaliz had a black mark under her cheekbone but she never said Cesar caused it.

Dwimoh then showed her pictures of the closet she got the children's clothes out from and Rivera confirmed that it was.

Defense lawyer, Kathleen Mullin did the re-cross. Mullin begins to chip away at the real reason Rivera counseled Nixzaliz to leave. Mullin pointed out that JAVIER WENT TO THE HOSPITAL AT THE END OF NOV., NIXZMARY WENT TO THE HOSPITAL AT THE END OF NOV., NIXZALIZ WENT TO THE HOSPITAL AT THE END OF NOV., (put 2 and 2 together and you come up with Cesar as the cause of them all going to the hospital)

Mullin pointed out that when when Nixzaliz went to the hospital the fighting would stop, but when she returned, the fighting resumed. Rivera said, yes. (Mullin is trying to say that when Cesar and Nixzaliz were together, they would fight--domestic violence)

Mullin asked for the 911 tape to be replayed. We all hear Nixzaliz crying in the background and wailing for her daughter.

Mullin then asked Rivera again, you said she was faking that??? Rivera said, yes.

D.A. Dwimoh does the re-direct and asked Rivera why she believes that Nixzaliz was faking on the tape. Rivera said, "her daughter is on the floor disfigured, she comes to my house, tells me calmly the baby drowned, when I go downstairs, I come across the girl like that. She's calm, the girl's dead, then when I talk to 911 then she starts making noise".

Rivera also said that she only counseled Nixzaliz to leave Cesar because of him not giving her money,-- no other reason.

Rivera said that prior to herself moving into the apartment, that she lived in a shelter.

Dwimoh asked Rivera if Nixzaliz had access to money other than Cesar.
